Please read this Terms of Services with care as this forms a contract between you and allaboutchild.org or www.allaboutchild.in (hereinafter called “AAC”). Here the terms, ‘All About Child’, AAC, we, us, our, have the same meaning as ‘AAC’.
This “Terms of Services” governs your access and use of the services, contents through the AAC Website or mobile application called “AAC App” provided by AAC which are meant for education, training and awareness creation among care-takers, care givers, teachers, parents, social workers, and all such persons who are involved and responsible for child cognitive and physical health development through creation and dissemination of study material, text, audio, video, images, and other content (collectively called “Content”).
By registering and using AAC website, you are agreeing to this Terms of Service and shall be bound by its terms. If you do not agree to be bound by these terms, you must not use the services. The “AAC App” is provided for free. The content is for educational purposes only and are not a substitute to expert advice and supervision. AAC has no liability to you for any loss suffered by you by registering and using the educational and information services provided by it.
You must be eligible to enter into this Agreement and you must have attained majority. The services provided by AAC is not meant for minors.
We in our sole discretion and at any given time may add, delete, revise or modify any part of this Terms of Agreement and Privacy Policy. We may similarly change this Agreement at any time without any prior notification. However, you can always obtain a up-to-date copy of this Agreement at AAC website. You must not use the services, if any change in the Agreement is not acceptable to you. The use and access of this website after the changes made to this Agreement shall constitute your acceptance of such changes.
Nature of Service
The allaboutchild.org and www.allaboutchild.in are social initiatives working towards increasing the availability of cognitive science and traditional knowledge on child development to all such persons who are in any manner and capacity linked to child rearing. AAC creates contents for educational and awareness creation in the form of video, audio, text, books, booklets, nameplates in digital medium and make them accessible to parents, teachers, Anganwadi workers and other child care givers through the AAC website, ACC mobile application, social media such as YouTube, Facebook, etc., and other digital modes of communications.
Anyone can access these educational material and other services on the ACC websites by visiting it or though registration and/or creation of an account by providing relevant details.
Access and Use of Service
To obtain access to the ACC Services, you need to visit the ACC websites, or optionally you may register to receive regular updates from ACC. ACC which allows users to register using their email or through Facebook and/or Google accounts.
To obtain access to the ACC Services using mobile application, the used must register and this may follow a verification process, wherein the verification code received as a SMS must be manually entered by the user. This completes the registration of the users for our services. The user agrees to allow us to access the address book, camera, photo gallery, cellular data and geographical location of their digital or communication device, mobile handset or phone. The services are available for free.
You shall not to use directly or indirectly the AAC Websites or Services for publication, distribution or conveying any material: (a) that is libelous, defamatory, hateful, or otherwise objectionable; (b) that infringes any intellectual property rights or confidential information of others; (c) that violates any applicable law or regulations. Users shall access and use this websites at their sole responsibility and shall be liable for their materials which are contravening to the above mentioned and similar natured activities. AAC has no liability of whatever nature for user’s activities and you bear the sole and exclusive risk associated with use of or reliance on the accuracy, quality, completeness, reliability or usefulness of any material.
You shall not to use or access directly or indirectly the AAC servers or clouds or its link in any manner that compromises the security features of the website including, without limitation: (a) unauthorized access to any data or information by logging onto an account, access devices or processor; (b) any attempt of investigation or test of the server and website of whatsoever nature for its authentication measures, security measures and other similar features regardless of your motives or intent; (c) any attempt to interfere with or disrupt the functioning of the web service to any user, processor, host or network, including, without limitation, by submitting a virus, worm or Trojan horse; (d) any attempt for sending advertising materials or unsolicited emails, etc.
AAC owns this websites and reserves all the rights to (a) modify, suspend or terminate operation of or access to the web service or any functions or features, without prior notice, for any reason; (b) interrupt the operation of the web services or any functions or features, as necessary to perform routine or non-routine maintenance, technical upgradation, error correction, or other changes.
Consent to Electronic Communications
By registering with AAC, you agree and understand that we may send some notices and updates on your use of our Services through SMS, emails, messages to User’s AAC account, or through some other electronic and digital means available.
Intellectual Property
The services, the interfaces, logos, software, images, designs, colour combinations, graphics, illustrations, patents, trademarks, service marks, copyrights, photographs, audio, videos and music and all the Intellectual Property Rights related thereto whether registered or not, are the exclusive intellectual property of AAC.
The content provided at ACC Website are the Intellectual Property of ACC and users have no rights over it. Users can access and use the content for the indented purpose of education, awareness creation only for non-commercial purposes. The user must not download, copy, stream, put in torrent sites, or distribute in any manner for any purposes. The Content may not be used, distributed or otherwise exploited for any commercial purpose, commercial advantage or private monetary compensation.
Prohibited Use
You shall not sell or rent any part of the Content or any derivative works based at least in Content or create any collective work that includes any part of the Content for educational training, support, or editorial services.
You shall not involve in sale of advertisements, sponsorships, or promotions placed on ACC Content, or any part thereof, or the sale of advertisements, sponsorships, or promotions on any website or blog containing any part of the Content, including without limitation any “pop-up advertisements”.
If you distribute, publicly perform or display, transmit, publish, or otherwise make available any Content or any derivative works thereof, you must also provide the following notice prominently along with such Content or derivative work thereof: “All ACC Content is available for free at allaboutchild.org and www.allaboutchild.in”
Indemnity
The users shall indemnify and will hold harmless AAC and its employees, officers, directors, agents, affiliates, subsidiaries, or contractors for any and all Losses such as awards, damages including attorney fees and cost awarded in any legal action by a third party arising out of user’s actual or alleged misappropriation or infringement of a third party’s intellectual property right, gross negligence, willful misconduct or violation of any law.
No Liability
IN NO EVENT SHALL AAC, ITS DIRECTORS, EMPLOYEES, AFFILIATES, SUBSIDIARIES OR AGENTS, BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER RESULTING FROM ANY INTERRUPTION OF SERVICES, ERRORS, MISTAKES, INACCURACIES OF CONTENT, ANY UNAUTHORIZED ACCESS TO OR USE OF YOUR CONTENT, ANY BUGS, VIRUSES, TROJAN HORSES, OR MALICIOUS CODE, WHICH MAY BE TRANSMITTED TO OR THROUGH OUR SERVICE BY ANY THIRD PARTY, FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF YOUR USE OF ANY CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, THE DISCLOSURE OF INFORMATION PURSUANT TO THESE TERMS OF SERVICE AND PRIVACY POLICY. THE FOREGOING LIMITATION OF LIABILITY SHALL APPLY TO THE MAXIMUM EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTION.
Disclaimer
YOU EXPRESSLY UNDERSTAND AND AGREE THAT YOUR USE OF OUR SERVICES IS AT YOUR SOLE RESPONSIBILITY OF RISK. THE SERVICE IS PROVIDED ON A “AS IS”, “WITH FAULTS” AND “AS AVAILABLE” BASIS. AAC AND AFFILIATES EXPRESSLY OVERRIDE, EXCLUDE AND DISCLAIM ALL LIABILITIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, STATUTORY OR CUSTOMARY, OR OTHERWISE, INCLUDING BUT WITHOUT LIMITATION THAT THE CONTENT WILL BE ACCURATE, USEFUL, EFFECTIVE, FREE OF ERROR AND THAT THE SERVICES WILL BE CONTINUOUS OR ERROR FREE, OR ANY WARRANTY OF SUPERIOR QUALITY OR FITNESS FOR PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
Termination
AAC reserves the sole discretion and right to suspend or terminate your access to the Service, both permanently and temporally at any time without giving any prior notice or cause, without incurring liability of any kind.
If you are found to be involved in spamming or similar activities to other users while using the application, AAC reserves all rights to suspend or terminate your access to the Service.
Third Party Content
The Services may contain some features and functionalities that link you to third party Web sites, directories, servers, networks, systems and the internet as a whole. The Services may contain some features and functionalities that give you the access to third party content, such as information and databases, applications, software, programs, products or services, etc. You agree and acknowledge that we shall not be responsible for such content or services in any manner or circumstances whatsoever.
We are not responsible for transactions of any nature or kind between you and any third party.
Force Majeure
AAC shall not be responsible for failure or delay of performance caused by an act of God, act of war, natural calamity, sabotage, electrical, internet, or telecommunication outage or other event outside its reasonable control. However, AAC shall take all necessary and reasonable steps for disaster recovery and meeting such situations.
Governing Law
The terms and conditions of this “Terms of Services” are governed by laws of Republic of India, particularly for interpretation of terms, claims for its breach and damages. For all disputes that may arise out of this contractual relationship, the parties consenting that the jurisdiction shall that of any competent court at Belagavi, Karnataka, India.
Entire Agreement and Severability
This is the entire agreement between AAC and You and is enforceable as a whole. The terms of this “Terms of Services” are applicable to the maximum extent permitted by relevant law. If a competent court of appropriate jurisdiction holds that any term either wholly or partly not enforceable or invalid, the rest of the terms shall be severable and remain in effect. Both parties shall replace such terms with new terms to the extent enforceable by law.
Assignment and transfer
This agreement is not transferable for you through assignment or otherwise. However, we may assign, transfer, or otherwise dispose our rights and obligations under this contract, in whole or in part, at any time without any prior notice.
